Woman sues JetBlue after suffering injury from ‘dangerously cold’ ice cream sandwich

A New Jersey woman sued JetBlue for allegedly serving her a ‘frozen solid’ ice cream sandwich that caused her to fracture one of her front teeth.

Kiara Quinonez claimed the flight crew gave her a Nightingale brand strawberry shortcake ice cream sandwich during an August 20 flight from New York’s JFK Airport to Charles De Gaulle Airport in Paris, France.

The lawsuit argued that the sweet treat was ‘at a temperature below what is reasonable or safe for consumption’ and Quinonez was not warned ‘of the dangerously cold temperature and solid state of the ice cream sandwich she was served.’

According to the lawsuit, Quinonez sustained ‘severe and permanent bodily injuries’ from biting into the ice cream sandwich, adding that she continues to incur expenses for ongoing treatment.

She is being represented by Christopher S. Fraser of the Dweck Law Firm, who demanded a jury trial to determine how much JetBlue should pay for the alleged damages.

Quinonez allegedly suffered a root fracture to tooth number 10 – also known as the upper left lateral incisor – which is right next to the left front tooth.

She needed ‘immediate’ medical treatment upon landing in Paris, according to the lawsuit. 

She claimed her injury required her to get the tooth extracted, after which she received an implant and other additional treatments.

‘As a direct and proximate result of the acts of Defendant, its agents and/or servants as aforedescribed, Plaintiff sustained severe and permanent bodily injuries, suffered pain, suffering and mental anguish, and incurred expenses for medical care and treatment, all of which are continuing,’ the lawsuit alleged.

The complaint was filed with New York’s Eastern District Court on October 22, months after the alleged incident occurred. 

DailyMail.com approached JetBlue for comment.

This comes months after another JetBlue passenger filed a lawsuit over severe burns she allegedly suffered from a spilled cup of hot tea.

Tahjana Lewis, a woman from Connecticut, was traveling in May with her 5-year-old daughter on a flight from Orlando, Florida, to Hartford, Connecticut, according to the June complaint.

Lewis claimed that when a fellow passenger was served the beverage by a flight attendant, the cup was dropped, causing the tea to spill all over her.

According to the lawsuit, Lewis now has severe burns her upper chest, legs, buttocks and right arm, some of which will be permanent.

The flight crew failed to ‘properly administer first aid’ after the spill, per the suit.

Lewis sought damages of more than $1.5 million, considering the severity of her injuries and the impact they’ve had on her ability to work her at her job, according to the suit.  

A similar lawsuit against JetBlue was filed back in 2017 by a 25-year-old woman, who like Lewis, claimed she suffered severe second-and-third-degree burns on her butt after allegedly being burned by excruciatingly hot tea during a flight.

Michelle Lavin claimed the incident happened on Labor Day weekend in 2014 when she was flying to visit her older sister for a weekend getaway during a five hour and 40 minute flight to Las Vegas from New York.
