The Parliamentary Body for Protectors of the Homeland in the House of Representatives and the Senate presents its proposals regarding amending the old rental law

The members of the parliamentary body of the Protectors of the Homeland Party in the House of Representatives and the Senate agreed on the necessity of taking into account social peace while dealing with the old rental file, especially since both landlords and tenants have viewpoints and visions that strengthen their position. 

 

This came during the discussion session organized by the Secretariat of Parliamentary Affairs of the Protectors of the Homeland Party, in the presence of members of the party’s House of Representatives and Senate, in light of what the Supreme Constitutional Court ruled regarding The unconstitutionality of the first paragraph in both Articles 1 and 2 of Law No. 136 of 1981 regarding some provisions related to renting places and regulating the relationship between landlord and tenant, and what it implies is the unconstitutionality of fixed rent for residential places.

In this regard, the representative confirmed Ahmed Bahaa Shalabi, Secretary of the Parliamentary Affairs Secretariat of Hamat al-Watan, Chairman of the party’s parliamentary body in the House of Representatives, said that the party aims to reach a comprehensive vision regarding the rent file.

 

The representative pointed out that Hamat al-Watan had previously opened the old lease file, explaining that the party had placed amending the law on its legislative agenda during the fifth session of the House of Representatives.

Ahmed Bahaa Shalabi confirmed that the party, in light of listening to both sides of the issue, will have recommendations and a vision for dealing with the old rental file in a way that achieves balance between all parties. 

For her part, Martha Mahrous, a member, stressed The House of Representatives stressed the need to work to achieve objectivity in solutions, noting the need for the party to adopt a limit on the number of old rental units.

She stressed the need for there to be a clear solution with regard to closed units, as well as properties that are at risk of collapse, and to limit them, stressing the need to It is necessary to have digital real estate certificates to prevent any tampering in determining whether or not properties are at risk of collapse. 

She said: These are tools that the representatives of the nation’s protectors must use before entering into the legislative amendment to the rental law.  

For her part, Representative Mervat Alexan Matar, a member of the House of Representatives, confirmed that the old rental file concerns a wide sector of the Egyptian people, so there must be a balance in the relationship between the landlord and the tenant. < /p>

She indicated that the House of Representatives is keen to interact with what the Supreme Constitutional Court ruled, and to come up with a balanced law that achieves the interests of both parties.

She stressed the importance of the digital inventory of real estate in Egypt, in a way that helps The Egyptian state must take the necessary measures regarding everything related to real estate.

Representative Ashraf Abu Al-Nasr, a member of the Senate, stressed the necessity of taking into account the social dimension in dealing with the old rent file, especially in light of the Supreme Constitutional Court’s ruling regarding the unconstitutionality of the rent. For residential spaces.

For her part, Representative Safaa Jaber Eyada, a member of the House of Representatives, stressed the need to deal objectively regarding amending the law against the backdrop of the Supreme Constitutional Rule, taking into account the interests of both owners and tenants. 

Representative Ruqaya Al-Hilali, a member of the House of Representatives, indicated that we need a new law, indicating that  Any reforms in the current law will not succeed at all because the issue is thorny and complex.

The representative suggested that the rental value be increased according to the area and the age of the property, in order to reach a consensual increase.

He pointed out  Representative Ahmed Abdel Salam Qura, a member of the House of Representatives, pointed out that reconsidering the prices for old rent benefits everyone, including the state, by enhancing revenues from real estate taxes. 

He said: The law It was issued in exceptional circumstances, and with the end of those circumstances, the amendment must be reconsidered, and in this regard resort to Islamic Sharia, as the main source of legislation. 

Representative Mustafa Badran, a member of the House of Representatives, stressed the necessity of relying on Raising the rental value of the units rented to real estate taxes according to the brackets, while solving the problem of properties that are in danger of collapsing as well as closed apartments.

While Representative Hisham Sweilem, a member of the Senate, confirmed that the old rent affects All parties, and social dimensions must be taken into account.

Major General Mahmoud Salah, a member of the Senate, stressed that legislative policy must be based on homogeneous elements, and must put social peace at the forefront of concerns. 

He stressed It is necessary for there to be a trade-off between several alternatives, in order to achieve balance, suggesting that the real estate crisis on the verge of collapse be resolved, and that there be a transitional period, let it be 10 years, with regard to the relationship.  

He agreed with the proposal that the rental value of the units should be calculated by the real estate tax value for each unit.

Representative Muhammad Tariq, a member of the House of Representatives, stressed the importance of determining an increase  The rental value is in proportion and according to each region.

The representative suggested that the Ministry of Solidarity Social Affairs, with a supervisory agency, conducted a social research on each tenant by region, stressing the need for abandoned apartments to be returned to their owners.

Major General Muhammad Majd al-Din, a member of the Senate, agreed with him, saying: The closed apartments must be handed over immediately.
