Diddy strikes back against $100 million default judgment… claiming he never received the lawsuit
Just days after Diddy was hit with a massive $100 million default judgment, the troubled music mogul is trying to fight it.
The 54-year-old rapper was sued by Derrick Lee Cardello-Smith for $100 million, claiming he was drugged and sexually assaulted him at a 1997 party.
Since Diddy did not formally respond to the lawsuit, or attend a virtual hearing that took place on Monday, the judge issued a default judgment against the rapper.
Starting October 1, Diddy would have to start paying $10 million monthly installments to Cardello-Smith.
However, Diddy filed an emergency motion on Thursday to dismiss the judgment, since, for one, he claims he never even received the lawsuit.

Documents filed by the music mogul claimed he didn’t know how to handle the matter since news outlets started reporting on it.
His lawyers are also strongly denying any wrongdoing, claiming the allegations are, ‘facially implausible allegations are completely fabricated.’
The lawyers also claim that, even if the allegations were true, the statute of limitations on those charges ran out 17 years ago.
Diddy’s team claim the lawsuit is frivolous, since the man filing it is a convicted rapist and they claim he has a history of filing frivolous lawsuits.
The lawsuit claims that Cardello-Smith and Diddy were both having sex with a group of women during a 1997 party, claiming that at one point, he felt Diddy’s hand touch his butt.
He also claims that Diddy spiked his drink and when he woke up, Diddy was having sex with another woman and claimed he said, ‘I did this to you too.’
Cardello-Smith, who is currently serving time in a Michigan prison, filed a restraining order against Diddy in August.
He provided records that proved Diddy visited him in prison, claiming he offered Cardello-Smith $2.3 million to drop the allegations against him.

Diddy’s lawyer Marc Agnifilo told DailyMail.com: ‘This man [Cardello-Smith] is a convicted felon and sexual predator, who has been sentenced on 14 counts of sexual assault and kidnapping over the last 26 years.
‘His resume now includes committing a fraud on the court from prison, as Mr. Combs has never heard of him let alone been served with any lawsuit. Mr. Combs looks forward to having this judgment swiftly dismissed.’
Last month, Combs filed a motion to dismiss a $30m lawsuit filed by record producer Rodney ‘Lil Rod’ Jones, who sued him for constant groping and a possible drug-induced rape.
Jones filed suit in February – just weeks before two of Combs’ homes were raided by federal agents amid a sex trafficking probe.
Jones claimed he was ordered to recruit prostitutes and have sex with them for the star’s pleasure, and has hundreds of hours of video documenting Combs’s ‘serious illegal activity.’ Diddy has denied all allegations of wrongdoing.
