Dar Al-Iftaa warns against fraud to seize cars designated for people of determination: a legal and moral crime

The Egyptian Fatwa House warned against fraud to seize imported cars for the benefit of people of determination.

 

The House said in its latest statements: One of the manifestations of Islamic law’s honoring of humans is that the law singles out people with special needs. They are inspired by characteristics that relieve them of embarrassment and help them in the affairs of life, and the Holy Qur’an refers to this by saying: “There is no burden on the blind, nor on the lame, nor on the sick, nor on yourselves that you eat from your homes Or your fathers’ houses or your mothers’ houses. verse} [النور: 61]

As stated in the Sunnah of the Prophet, there is evidence that embarrassment is removed from all those who have excuses. Imam Bukhari narrated in his “Sahih” On the authority of Imran bin Husayn, may God be pleased with him – and he had an excuse that prevented him from praying while standing – he said: So I asked the Prophet, may God’s prayers and peace be upon him and his family, about prayer, and he said: “Pray standing, and if you are not able, then sitting, and if you are not able, then lying on your side.”The House praised – from this standpoint – the state’s allocation of some specializations to people of determination; To seek help in their affairs, and to invest their energies in life; To strive towards a better life for them, including the state allocating their cars by exempting them from customs taxes or from some financial dues.

The house added that any fraud or illegal manipulation, in addition to being an illegal and immoral act, goes towards this goal. Privatization, in fact, leads to harm in the care of people of determination themselves on the one hand, and causes harm to the state on the other hand.

The house continued: Fraud and manipulation are contrary to fulfilling the contract and promise, and the Almighty said: “O you who have believed, fulfill your contracts.” [المائدة: 1]And on the authority of Abu Hurairah, may God be pleased with him, that the Prophet, may God’s prayers and peace be upon him and his family, said: “Muslims are subject to their conditions as long as the truth agrees with them.” Narrated by Ibn Hibban in “Al-Sahih” and Al-Hakim in “Al-Mustadrak.”

It is also a betrayal of trust, as God Almighty said: “O you who have believed, do not betray Allah and the Messenger, nor betray your trusts while you know.” [الأنفال: 27]

The Fatwa House concluded its statement by calling on society to cooperate and stand together to preserve the rights of people of determination, to deliver them to those who deserve them, and to call on state institutions to take the necessary measures to ensure that the allocation reaches those who deserve it.
